Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Initsale platform and services ("Service"). It is incorporated into and forms part of our Terms of Service. Violation of this AUP may result in suspension or termination of your account.

1. Prohibited Content

You may not use the Service to store, transmit, or distribute content that:

  • Is illegal under applicable law, including Polish and EU law
  • Infringes on intellectual property rights (copyright, trademarks, patents)
  • Contains malware, viruses, or other harmful code
  • Promotes violence, terrorism, or hatred against individuals or groups
  • Contains child sexual abuse material (CSAM) or exploits minors
  • Constitutes harassment, bullying, or threats
  • Is defamatory, fraudulent, or intentionally misleading
  • Violates the privacy rights of others
  • Contains pornographic or sexually explicit material in storefronts or landing pages

2. Prohibited Activities

You may not use the Service to:

2.1 Email Abuse

  • Send unsolicited bulk email (spam)
  • Send emails to purchased, scraped, or harvested email lists
  • Forge email headers or impersonate others
  • Send phishing emails or engage in social engineering attacks
  • Circumvent unsubscribe mechanisms or send to contacts who have opted out

2.2 Security Violations

  • Attempt to gain unauthorized access to other users' accounts or data
  • Probe, scan, or test vulnerabilities without explicit written authorization
  • Interfere with or disrupt the Service, servers, or networks
  • Circumvent rate limits, usage quotas, or access controls
  • Attempt to access data belonging to other tenants

2.3 Deceptive Practices

  • Create fake accounts or misrepresent your identity
  • Use the Service to operate fraudulent schemes or scams
  • Sell counterfeit goods through your storefront
  • Misrepresent products, prices, or delivery terms to your customers

2.4 Resource Abuse

  • Use automated scripts to generate excessive load on the Service
  • Use cloud storage for content unrelated to your business operations
  • Create multiple free accounts to circumvent plan limits
  • Resell or sublicense the Service without authorization

3. Storefront and Landing Page Requirements

If you operate a public storefront or landing pages through the Service, you must:

  • Provide accurate product descriptions and pricing
  • Display your own contact information and business details
  • Comply with applicable consumer protection laws
  • Not sell prohibited items (illegal goods, weapons, controlled substances, etc.)
  • Handle customer complaints and refunds in accordance with applicable law

4. Data Protection Responsibilities

When using the Service to manage customer data, you must:

  • Have a lawful basis for collecting and processing your customers' personal data
  • Provide your own privacy policy to your end users
  • Respond to data subject requests from your customers (access, deletion, etc.)
  • Promptly notify us of any data breaches affecting Customer Data
  • Not use the Service to process special categories of data (health data, biometric data, etc.) without appropriate safeguards

5. Enforcement

We reserve the right to investigate suspected violations of this AUP. Depending on the severity and nature of the violation, we may:

  • Issue a warning and request corrective action
  • Temporarily suspend your account or specific features (e.g., email sending)
  • Permanently terminate your account
  • Report illegal activity to law enforcement authorities

Where possible, we will provide notice before taking action and give you an opportunity to correct the violation. However, we may act immediately without notice in cases involving illegal content, security threats, or spam that damages our sending reputation.

6. Reporting Violations

If you become aware of a violation of this AUP by another user, or if you receive content through the Service that you believe is illegal, please report it to: abuse@initsale.com

We will review all reports and take appropriate action in accordance with applicable law, including the EU Digital Services Act.

7. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated via email or in-app notice.
